These Terms & Conditions (“Terms”) govern your use of fxtoolskit.com and purchases of our software products, including Trade Journal Pro EA (MT4/MT5) (“Products”). By using the site or placing an order, you agree to these Terms and to our Licensing Policy Privacy Policy & Refund & Returns Policy which are incorporated by reference.

1) Who we are

“FXToolskit,” “we,” “us,” or “our” refers to the operator of fxtoolskit.com. Contact: support@fxtoolskit.com.

2) Scope & acceptance

These Terms apply to the website, your account (if any), ordering/checkout, delivery of digital products, and support. Product licensing rules (platform-specific, seats, account slots, transfers, refunds) are governed by our Licensing Policy.

3) Accounts & eligibility

You must be able to enter a binding contract and comply with these Terms and the Licensing Policy. Keep your credentials and license keys confidential and don’t share them.

4) Orders, pricing & taxes

Prices, currencies, and promotions may change at any time. You are responsible for any taxes, duties, or fees where applicable. Obvious pricing errors may be canceled/refunded.

5) Digital delivery

Products are delivered digitally (download links and/or license emails) after payment is confirmed. Keep your email accurate so you receive delivery and support messages.

6) License & permitted use (summary)

Your purchase grants a software license, not ownership. Licenses are platform-specific (MT4 vs MT5) and subject to seats, account slots, transfers, and verification rules in the Licensing Policy. You may not resell, share, lease, reverse-engineer, or circumvent license checks.

7) Refunds, cancellations & renewals

Software licenses are non-refundable once delivered/activated, except where required by law. Subscriptions (if offered) renew until canceled; cancel before the renewal date to avoid further charges. Effects of cancellation are described in the Licensing Policy. See our Refund & Returns Policy

8) Updates & changes to products

We may provide updates, fixes, or improvements during your active license term (or for the life of a lifetime license), and may modify or discontinue features where necessary (e.g., broker/platform changes). We aim for reasonable compatibility with current MT4/MT5 builds.

9) Support

Email support is available Mon–Fri, 11:00–21:00 (UTC+6). Typical response time is within 1 business day. Use the Contact page forms for licensing/PC transfers and general support.

10) Trading & risk disclaimer (important)

We do not provide financial advice. Past performance is not indicative of future results. Trading involves risk of loss. You are solely responsible for your trading decisions, risk management, and compliance with your broker’s rules.

11) Warranty disclaimer

Products and the site are provided “AS IS” and “AS AVAILABLE.” To the maximum extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

12) Limitation of liability

To the maximum extent allowed by law, our total liability for any claim related to the Products or site shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or trading losses.

13) Third-party platforms & brokers

We rely on third-party platforms (e.g., MetaTrader, your broker). We don’t control their uptime, changes, or policies. You must keep your platform updated and configured according to our docs.

14) Intellectual property

All software, content, documentation, names, and logos are owned by us or our licensors. You receive only the license rights described in the Licensing Policy.

15) Privacy

We handle personal data as described in our Privacy Policy (e.g., email, order info, license data, HWID/account IDs for validation).

16) Changes to these Terms

We may update these Terms; changes apply to new purchases from the “Last updated” date and to ongoing use of the site thereafter.
